1 Company and scope
These Terms govern access to and use of this website, including its information, enquiry forms and any demonstrations made available through it. The website is operated by Hero Entertainment (M) Sdn Bhd (Company Registration No. 202101022943 (1423243-K)), referred to as “we”, “us” or “our”. “You” means the person accessing the website or, where applicable, the business that person is authorised to represent.
By using the website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, discontinue use. Where a feature requires express acceptance, you must accept the applicable terms before using it.
2 Service agreements take priority
Paid subscriptions, implementation, integrations, support and other customer services require a separate service agreement or accepted order. That document will specify the scope, fees, payment arrangements, renewal, cancellation, refunds, service levels and other commercial terms. If these Terms conflict with that document concerning the contracted services, the service agreement or accepted order takes priority. Visiting the website or submitting an enquiry does not itself create a paid subscription.
3 Authority and accounts
You must have legal capacity to accept these Terms. If you act for a business, you must have authority to do so. Where an account is provided, supply accurate information, protect your login credentials and promptly notify us of suspected unauthorised access. Do not share access beyond the users authorised under the applicable service agreement.
4 Permitted use
You may access the website for lawful information, evaluation and business enquiries. You must not use it to commit fraud, infringe intellectual property or privacy rights, upload malicious code, bypass security controls, access another person’s information without authority, or interfere with the website or connected systems. Automated extraction or access that imposes an unreasonable load or bypasses access controls is prohibited unless authorised by us in writing or permitted by applicable law.
5 Intellectual property
Except for your data and third-party materials, rights in the website content, branding and materials are owned by Hero Entertainment (M) Sdn Bhd or used under licence. Access gives you a limited permission to view the website and use its features for their intended purpose. It does not transfer ownership or grant a right to reproduce, commercially distribute or use our branding without permission, except as permitted by law.
“AI” is descriptive of artificial intelligence. We do not claim exclusive trademark rights in “AI” separately from the SoWork AI mark. Any rights in the overall mark and logo remain subject to applicable law and any recorded registration conditions. Nothing in these Terms asserts that a trademark is registered where registration has not been obtained.
6 Information and data you submit
You retain any ownership rights you have in information and materials you submit. You must have the necessary rights, permissions and lawful basis to provide them. Do not submit another person’s confidential information or personal data without authority, or send sensitive operational data or credentials through general enquiry forms.
You authorise us to use submitted information only as reasonably necessary to respond to your enquiry, provide a requested demonstration or perform agreed services, subject to applicable law and our Privacy Notice. This clause does not grant blanket permission to train general-purpose AI models on your confidential business data. Any such use requires a separate lawful basis and express agreement where applicable.
7 Personal data and confidentiality
Our separate Privacy Notice explains how personal data is collected, used, disclosed and retained, including relevant service providers, transfers and your rights. These Terms do not replace that notice or any required consent. Where customer services involve processing personal data or confidential business records, the applicable service agreement and data processing terms will govern the parties’ responsibilities. Nothing in these Terms removes our obligations under applicable data protection law.
8 AI outputs and demonstrations
AI outputs are subject to the limitations described in our Website Disclaimer. You are responsible for verifying outputs and authorising business decisions or actions. Any automation affecting transactions, communications, inventory, staff or other operations must be configured and authorised under the applicable service agreement. A demonstration does not confer permission for production use or establish a promised feature, result or service level.
9 Third parties and availability
Some features depend on external systems, hosting providers, AI models or integrations. Their availability and functionality may change, and separate third-party terms may apply. We do not guarantee uninterrupted website access or that every feature will always be available. Contracted availability and support obligations, if any, are set out in the applicable service agreement.
10 Liability
We will exercise reasonable care in operating the website. To the extent permitted by law, we exclude implied warranties regarding website content or free demonstrations and are not liable for indirect or consequential loss, or loss of anticipated profits or savings, arising from their use. This clause applies to website access and free demonstrations; liability for contracted customer services is governed by the applicable service agreement.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited. Mandatory consumer rights and statutory data protection obligations remain unaffected. You remain responsible for decisions made using AI outputs, but this does not excuse any breach of our own contractual or legal duties.
11 Suspension and termination
We may restrict or suspend website or demonstration access where reasonably necessary to address a security threat, unlawful activity or material breach of these Terms. Where practicable, we will give notice and an opportunity to resolve the issue. Suspension, termination, data export and deletion for paid services are governed by the applicable service agreement and legal requirements.
12 Changes
We may update these Terms or the Disclaimer by publishing a revised version and effective date. Changes apply prospectively and do not retrospectively amend an existing service agreement. Where required by law or the nature of a change, we will provide additional notice or obtain fresh acceptance.
13 Governing law and disputes
These Terms are governed by the laws of Malaysia. The Malaysian courts have jurisdiction over disputes arising from them, subject to mandatory rights or jurisdictions that apply by law. A different dispute resolution arrangement expressly agreed in a customer service agreement applies to disputes within that agreement’s scope.
14 General provisions
If a provision is unlawful or unenforceable, it will be ineffective only to the extent necessary, and the remaining provisions will continue to apply. Failure to enforce a provision immediately does not waive the right to enforce it later. These Terms, the Website Disclaimer and any applicable service agreement govern their respective subject matter without excluding rights or remedies that cannot be excluded by law.
